A 35-year-old car dealer was docked at a Yaba Chief Magistrates’ Court on Thursday for allegedly obtaining two Mack trucks valued at N5.2million on the pretext of assisting the complainant to sell them.
The accused, Adebayo Olusola, who resides in Isolo area of Lagos State, is facing a three-count charge of obtaining by false pretences, stealing and issuing a dud cheque.
The Prosecutor, ASP Godwin Anyanwu, told the court that the accused committed the offences on Sept. 10, 2012 at No.23, Lanre Egbegbune St., Ajao Estate, Lagos State.
Anyanwu said that the accused fraudulently obtained the two Mack trucks with Reg. Nos: XX 722 AGL and XV 944 JJJ respectively from one Mr Collins Mgbakor, on the pretext that he would assist him to sell them.
“The accused sold the trucks as promised but he refused to remit the proceeds to the complainant on demand.
“The accused, however, issued two dud cheques belonging to Diamond Bank of Nigeria Plc., leaflet No. 45648796 for the sum of N2.2million and another cheque leaflet No. 45648797 for the sum of N3million to the complainant,” Anyanwu added.
According to the prosecutor, the offences contravened Sections 285, 312 and 319 of the Criminal Law of Lagos State, 2011.
The News Agency of Nigeria (NAN) reports that Section 312 stipulates 15 years’ imprisonment for anyone culpable of obtaining by false pretences.
However, the accused pleaded not guilty to the charges.
The Chief Magistrate, Mrs A.O. Soladoye, granted the accused bail in the sum of N500,000 with two sureties in like sum and adjourned the case till July 8 for trial.
