Court adjourns Ojora stool suit to June 13
A Lagos State High Court sitting in Igbosere has adjourned till June 13, 2015 for mention, a suit challenging the appointment and installation of Oba Fatai Aremu as the Ojora of Lagos.
The Adeshiba Ayeloja royal family, which filed the suit, is seeking a court order directing the Lagos State Government to confirm the nomination and appointment of its own candidate, Shehu Adedewe.
The family is seeking an order of perpetual injunction restraining Chief Ojora of Lagos from parading himself as Oba of Ojora.
Listed as defendants in the suit are Oba Fatai Aremu, Chief Fatai Olumegbon, the Governor of Lagos State, the Lagos State Attorney General and Commissioner for Justice, the Lagos State Commissioner for Local Government and Chieftaincy Affairs, and the Oba of Lagos, Oba Rilwan Akiolu.
The Ayeloja family claimed that by virtue of the supplement to the Western Regional gazette No 5 volume 8 dated January 22, 1959 together with the recorgnised chieftaincies order of 1958, the defendants were not entitled to impose a king on the community.
The family, through its lawyer, Olusegun Raji, wants the court to declare the nomination, appointment and installation of the first defendant as unconstitutional and of no effect.
The presiding judge, Justice Abdulfattah Lawal, last week, granted the leave of the court to the applicant to serve the motion on notice dated March 30, 2015 on the Ojora of Lagos by substituted means.
The applicant had, in a motion ex parte brought pursuant to Order 7, Rule 5(1) of the High Court of Lagos State (Civil Procedure) Rules, 2012, prayed the court for an order of substituted service of court processes on the monarch by pasting them on the wall or through courier service.
